Cherry Voice AI ("Cherry", "we", "us") provides a phone-ordering and front-desk service for restaurants. This policy explains what personal information we handle, why, who we share it with, how long we keep it, and what choices you have. It covers our website (cherryvoice.io), our live demo phone line, and the Cherry service that restaurants use to take orders from their own customers.
Cherry is operated by Cherry Voice Business Solutions, 49450 Conservation Trl, Shelby Twp, Michigan.
Two roles: restaurant customers and their callers
Cherry has two kinds of relationships, and the rules differ.
- Restaurants and prospective restaurants who visit our website, request a demo or sign up. For their information we decide how it is used, as described below.
- People who call or order from a restaurant that uses Cherry. The restaurant is in charge of that relationship. We handle the calls, orders and texts on the restaurant's behalf as its service provider, and only to run the service for that restaurant. If you ask us about information from an order you placed with a restaurant, we may pass your request to that restaurant.
What we collect
When you visit our website. Our servers record the technical details of each request (your IP address, browser, the pages requested and the time). We do not currently use advertising cookies, advertising trackers or third-party analytics on the website. If that changes we will update this policy first.
When you ask for a demo. The restaurant name, your name and your phone number that you type into the form, so we can call you back. Please do not put anything else in it.
When you call our demo line. Our demo line is answered by an automated assistant. We process your phone number (caller ID) and what you say, as a text transcript, to run the demonstration. Demonstration orders are not real orders and nothing is prepared or charged.
When you call or order from a restaurant that uses Cherry. Depending on how the restaurant has set the service up:
- your phone number (caller ID);
- what you say during the call, as a text transcript;
- the order you place: items, choices, quantities, totals and pickup details;
- the name you give, and any allergy or dietary notes you mention (we pass these to the kitchen; we do not decide whether any dish is safe);
- the phone number we send your checkout text to, and delivery records for that text;
- whether payment was completed, and the payment reference (never your card number);
- information about how the call sounded (see "How your voice is analysed" below).
Recordings. Cherry stores the transcript of a conversation, not the original call audio. The call's audio is handled in real time by our telephony and speech providers. Our telephony and speech providers handle audio under their own terms and privacy policies.
Returning callers. Unless the restaurant turns it off, Cherry may recognise a returning caller by phone number so it can greet them and offer their previous order. A caller who does not want this can tell the restaurant or write to us (see "Your choices").
How your voice is analysed
Our speech provider can estimate how a caller sounds: for example whether the voice is calm or upset, loud or quiet, hard to hear, and the pitch. Cherry uses this only to respond more helpfully, such as speaking more slowly, apologising, or offering to connect the caller to a person. The provider can also estimate a caller's age range and accent. Cherry does not use age or accent to make any decision, does not show them to the restaurant, and does not store them. We store the mood, volume, clarity and pitch results for a call with that call's records, for the period in "How long we keep information".
How we use information
- to answer calls, take orders and send them to the restaurant's counter screen;
- to send you the secure checkout text and messages about your order;
- to take payment through our payment provider;
- to contact a restaurant that asked for a demo;
- to keep the service working, secure and free of fraud and prank orders, and to find and fix problems;
- to give restaurants their order history and reports;
- to comply with law and enforce our terms.
We do not sell personal information, and we do not share it for advertising.
Text messages
When you place an order by phone, we send a text to the number you used, or to one you give us, containing a secure checkout link and messages about that order. These are transactional texts about an order you started. We do not send marketing texts to callers. Message and data rates may apply. Reply STOP to stop texts from us, or email support@cherryvoice.io for help. We keep a record of opt-outs so we honour them. Mobile numbers and opt-in information are not shared with third parties for their marketing; they are shared only with the carriers and messaging providers who deliver the texts.
Payments
Payments are processed by Stripe. You enter your card details on Stripe's secure checkout page; Cherry never receives or stores your card number. Stripe's use of your information is governed by its own privacy policy.
Who we share information with
- The restaurant you ordered from: your order, name, phone number and transcript of that conversation.
- Service providers who run Cherry for us, only so far as they need to: telephony and text messaging (Telnyx and, as a standby, SignalWire); speech recognition and voice generation (Inworld, and the AI model providers it uses); payments (Stripe); hosting and infrastructure (Hostinger); and email and billing tools. Each is bound to use the information only for providing its service to us.
- Authorities and others when the law requires it, or to protect people, our service and our rights.
- A buyer or successor, if Cherry is sold or merged, with the same protections for your information.
How long we keep information
We keep information only as long as needed for the purposes above and to meet legal obligations, then delete it or make it unidentifiable.
- Call transcripts and voice-analysis results: up to 12 months.
- Order and payment records: up to 7 years (we may be required to keep some for tax and accounting).
- Text message delivery records: up to 4 years. Opt-out (STOP) records are kept for as long as we send texts, so that we never text a number that has opted out.
- Demo requests: up to 12 months.
- Website server logs: up to 90 days.
Security
We use technical and organisational measures intended to protect information, including encrypted connections, restricting access to those who need it, keeping each restaurant's records separate, and never storing card numbers. No system is perfectly secure, and we cannot guarantee that information will never be accessed or disclosed by mistake.
Your choices and rights
You can ask us to tell you what we hold about you, to correct it, or to delete it, by emailing support@cherryvoice.io. Depending on where you live (for example California and several other states), you may have additional rights, including to know, correct, delete and opt out of the sale or sharing of personal information, and not to be treated unfairly for using those rights. We do not sell or share personal information for advertising. If you ordered from a restaurant, we may need to pass your request to that restaurant, and we will tell you if so. We will respond within the time the law requires.
To stop texts, reply STOP. To stop a restaurant from recognising you when you call, ask the restaurant or write to us.
Automated assistant
Calls to a restaurant that uses Cherry, and to our demo line, are answered by an automated assistant. If you ask whether you are speaking to a person, it will say that it is a virtual team member. You can ask to be connected to the restaurant's staff at any time.
Children
Our website and service are not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child has given us information, write to us and we will delete it.
Changes to this policy
We may update this policy. We will post the new version with its date, and if a change is material we will tell restaurant customers by email before it takes effect.
